Can my flashed xbox 360 still get banned from xbox live if I am only playing an actual xbox game?

If i was to fool around an tangible xbox 360 diversion upon xbox live regulating the flashed xbox 360 could Microsoft still find out which my xbox 360 has been flashed as well as anathema it from live forever? Or is it which only for the people who fool around the burnt diversion upon live who get held with the flashed xbox 360

1. The console itself is what is detected not the games so yes, you can get caught and banned from Live even if you only play legal games.

2. Yes Ms checks the Console not the actual game. So yeah…be careful lot of banning going on right now…
